General Terms and Conditions (GTC)

§ 1 Scope, Definitions

(1) K & K Dackelmanufaktur GbR, Saselbekstraße 80, 22393 Hamburg, Germany (hereinafter “we” or “Die Dackelmanufaktur”) operates an online shop for goods, in particular dachshund products and gift vouchers, at www.dackelmanufaktur.de. These GTC apply to all contracts concluded via this shop.

(2) A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession. A trader is any natural or legal person who, when concluding a legal transaction, acts in the exercise of their trade, business or profession.

§ 2 Conclusion of Contract

(1) Our product presentations do not constitute a legally binding offer, but a non-binding invitation to place an order.

(2) By submitting your order via the “order with obligation to pay” button, you make a binding offer to conclude a contract. The contract is concluded as soon as you receive an order confirmation from us by email.

(3) The GTC and information on the right of withdrawal will be sent to you by email as part of the order confirmation. We do not permanently store the contract text.

§ 3 Prices, Shipping and Payment

(1) As a small business pursuant to § 19 UStG (German VAT Act), we do not charge VAT.

(2) The prices stated are exclusive of shipping costs. Information on shipping costs can be found under Shipping & Returns.

(3) Payment is made using one of the payment methods offered during the ordering process. Digital products are delivered exclusively by email to the address provided.

§ 4 Delivery

(1) Items ready for immediate dispatch are shipped within 1–3 business days. Handcrafted products are made in our Hamburg manufactory after you place your order (production 2–5 business days); please allow a total delivery time of 7–10 business days for these.

(2) Digital products (e.g. gift vouchers) are sent by email immediately after purchase.

§ 5 Retention of Title

The goods remain our property until paid for in full.

§ 6 Right of Withdrawal

Consumers have a right of withdrawal in accordance with our withdrawal policy.

§ 7 Warranty and Liability

(1) Statutory warranty rights apply.

(2) In the case of slightly negligent breaches of duty, we are only liable for breaches of essential contractual obligations. Liability is limited to foreseeable damage typical of the contract.

(3) Liability for injury to life, body or health remains unaffected.

§ 8 Contract Language, Governing Law

(1) The contract language is German.

(2) German law applies. The UN Convention on Contracts for the International Sale of Goods is excluded.

§ 9 Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here: https://ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 10 Final Provisions

Should individual provisions of these GTC be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
