[title text="Privacy Policy"]
Transparency in handling our customers' data is particularly important to us. In the following privacy policy, we therefore provide comprehensive information about the type, scope and purpose of the collection, storage, use and processing of personal data on the website www.dackelmanufaktur.de, on which this privacy policy is posted ("Website").
Personal data means any information relating to an identified or identifiable natural person; a natural person is considered identifiable if they can be identified directly or indirectly.
This privacy policy applies to the use of data that comes to our knowledge or is collected in connection with the use of the Website. It does not apply to websites and services of other providers to which our websites or services may link, insofar as this privacy policy is not posted on such websites. We recommend that you read the privacy policy of any other service provider you use, particularly before providing them with personal data.
The provider of this website and the controller within the meaning of data protection law is Die Dackelmanufaktur, Kiefer & Kiefer II GbR, Saselbekstraße 80, 22393 Hamburg, Phone: +49 (0)40 2285 2550, Email: support(@)dackelmanufaktur.de (hereinafter: "we"/"us").
You can access this information on our website at any time and contact our data protection officer with questions and concerns.
Information about data processing
We process a range of personal data, particularly when you visit our website. We use your data only in accordance with the applicable legal provisions (in particular the GDPR, the TMG and the BDSG n.F.) and this privacy notice, as well as, where applicable, in accordance with your prior consent.
In many cases, we use data only in pseudonymised or anonymised form. Anonymisation means your data is altered or shortened in such a way that it can no longer be assigned to a specific person. Pseudonymisation means personal data is processed in such a way that it can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data is not attributed to an identified or identifiable natural person.
1. Usage data
In addition to the information you provide yourself, we automatically collect a range of data in connection with your use of our websites, in particular regarding the type and extent of your use of our services, without any action on your part.
a. What data is collected automatically?
Automatically collected data includes data that is not directly personal, such as the time and duration of access to our website, the pages displayed or products viewed, search terms used and the pages from which you arrived at our website, as well as other data automatically transmitted by your PC or mobile device, e.g. in the form of log files containing information about the hardware you use, your operating system, browser information, language settings, your screen resolution and your access provider.
b. For what purposes do we process usage data?
We use your data to enable you to use our services, to correct technical problems, to ensure the continued functioning of our products and services, to improve and further develop them in line with user needs, and for the targeted marketing of our products. We use the automatically collected (anonymised or pseudonymised) usage data where this is necessary to safeguard legitimate interests and where there are no overriding user interests in the protection of your personal data (legal basis: Art. 6(1)(f) GDPR), in particular for the following purposes:
- to carry out targeted marketing measures based on information about your use of our website;
- to determine the success of marketing measures, in particular conversion rates for advertisements and newsletters;
- to gain a better understanding of user behaviour in order to optimise our website processes;
- to determine your approximate location for offering country- and language-related services and functions as well as statistical evaluations of the use of our services;
- to check the functioning of our website and eliminate any sources of errors and security risks.
c. How is data collected automatically?
For the automated collection of usage data, we use technologies such as cookies to passively collect usage data on our websites without your active involvement. These include in particular:
(a) Cookies
Cookies are small text files that are stored on your computer or other device when you use our services. Such cookies may store usage data in order to save your preferences, login details and settings for future visits or to personalise advertising within our website for the respective user. Cookies may create links to information regarding orders you have placed or pages you have viewed. This information is used, for example, to track your shopping cart and to ensure that you are not repeatedly shown the same advertisement. In addition, we use cookies to offer you content and advertising tailored to your interests and to record your use of the website for statistical purposes.
In addition to the cookies we set when you use our services, third parties may also place cookies when you visit our websites. This happens because we have commissioned third parties to collect information for us, e.g. for statistical usage analysis (e.g. through the use of Google Analytics).
Most browsers are automatically set to accept cookies when visiting a website. You can disable cookies or set your browser to display a warning as soon as cookies are sent. However, if cookies are disabled, some areas of our websites may not function properly. You can set your web browser to display a warning when cookie placements are attempted on your computer or to restrict the type of cookies you allow.
We use cookies where this is necessary to safeguard legitimate interests, namely to enable an effective and user-friendly website, and where there are no overriding user interests in the protection of their personal data (basis: Art. 6(1)(f) GDPR).
For information about and management of the cookies we use, we use the Cookiebot service. You can view and change your settings for the use of cookies on our website here.
(b) Internet protocol files
We may also store log files that your PC automatically transmits to our web server. These log files typically contain information about your computer or device, in particular browser type/version, operating system used, URL of referring websites, and date and time of access.
The legal basis for processing is Art. 6(1) sentence 1(f) GDPR. The legitimate interest in processing lies in technically enabling access to the website, optimising the presentation of content for the user, and the future further improvement/optimisation of the website.
(c) Other technologies
a. Google Analytics
We use Google Analytics on our websites, a web analytics tool from Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). Google Analytics uses "cookies" that are stored on your PC and enable analysis of your use of the website. The information generated by the cookie includes, for example, browser type/version, operating system used, screen resolution, referrer URL (the previously visited page), anonymised IP address of the accessing computer, time of server request, duration of visit to individual pages, files downloaded, videos viewed, advertising banners clicked, orders placed, click paths, etc. You can find more information about the cookies used by Google here.
This information may be transmitted to a Google server in the USA and stored there. Google has committed to complying with the Privacy Shield agreement between the EU and the USA on the collection, use and storage of personal data from EU member states, as published by the US Department of Commerce. You can view the corresponding certificate here.
We use Google Analytics on our websites with an IP anonymisation tool, with which your IP address collected by Google Analytics is shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area before being transmitted, and thus transmitted in anonymised form.
Google uses the collected information on our behalf on the basis of an agreement we have concluded with Google to statistically evaluate the use of the website for us in aggregated form, to create reports on website activities and user behaviour on our website, and to provide us with further analysis services related to the website and its use. These reports help us to design our site and its content according to needs and to continuously optimise it. The IP address transmitted by your browser as part of Google Analytics is not merged with other Google data.
You can find extensive information from Google about data processing in connection with Google Analytics here.
The maximum retention period we have chosen for data linked to cookies or user IDs and advertising IDs is 14 months. After this retention period expires, the data is automatically deleted.
The legal basis for the use of Google Analytics is Art. 6(1) sentence 1(f) GDPR. The legitimate interest in processing lies in the analysis of usage data in order to identify and eliminate errors on the basis of these findings and to make optimisations with regard to website design, including with regard to increasing the conversion rate.
In the case of data processing on the basis of Art. 6(1) sentence 1(f) GDPR, you have a right to object, without prejudice to further rights. See section 11 "Data subject rights" in this regard.
The storage of cookies can be prevented by changing the browser settings accordingly; in addition, stored cookies can be deleted by you via your browser. This may result in certain functionalities of the website visited not being usable at all or not comfortably usable.
You can also specifically disable the Google Analytics function by means of a browser add-on, which you can download at https://tools.google.com/dlpage/gaoptout. To do this, you must install this browser add-on on all devices you use. This prevents analysis information from being sent to Google. Alternatively, you can set a so-called opt-out cookie by clicking on this link, which prevents future data collection via Google Analytics. Please note, however, that if you delete cookies in your browser settings, this opt-out cookie will also be deleted and must be set again by you.
b. Google Remarketing
We use the DoubleClick service and other remarketing tools from Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google") on our websites.
DoubleClick and Google's other remarketing tools use cookies to present you with advertisements relevant to you. A pseudonymous identification number (ID) is assigned to your browser in order to record your usage behaviour. The cookie thus enables Google and its partner websites to display ads based on your previous visits to our or other websites that match your usage behaviour and thus presumably correspond to your interests. The cookies do not contain any further information about you. The information generated by the cookies is transmitted by Google to a server in the USA for evaluation and stored there. Google has committed to complying with the Privacy Shield agreement between the EU and the USA on the collection, use and storage of personal data from EU member states, as published by the US Department of Commerce. You can find the certificate here. Data is transmitted by Google to third parties only on the basis of legal regulations or in the context of data processing on our behalf. Under no circumstances will Google combine your data with other data collected by Google. You can find extensive information from Google about data processing in connection with DoubleClick and Google's other remarketing tools here.
The processing of your data in connection with DoubleClick is based on our legitimate interest in displaying advertisements classified as relevant to you based on your use of our website, and thus being able to carry out more effective marketing measures (Art. 6(1) sentence 1(f) GDPR).
In the case of data processing on the basis of Art. 6(1) sentence 1(f) GDPR, you have a right to object, without prejudice to further rights. See section 11 "Data subject rights" in this regard.
You can prevent the storage of the DoubleClick cookie as described below.
The storage of cookies can be prevented by changing the browser settings accordingly; in addition, stored cookies can be deleted by you via your browser. This may result in certain functionalities of the website visited not being usable at all or not comfortably usable.
You can also specifically disable the DoubleClick function by means of a browser add-on, which you can download here. To do this, you must install this browser add-on on all devices you use. This prevents analysis information from being sent to Google. Alternatively, you can disable DoubleClick cookies on the Digital Advertising Alliance website at the following link, which sets a so-called opt-out cookie. Please note, however, that if you delete cookies in your browser settings, this opt-out cookie will also be deleted and must be set again by you.
d. Links to Google Maps
We embed links on our website to the Google Maps service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), to illustrate the location of our company to users and to make it easier to find us.
When you access these links, information (such as your IP address) is transmitted to Google servers in the USA and stored there. This happens regardless of whether Google provides a user account through which you are logged in or whether no user account exists. If you are logged in to Google, your data will be directly assigned to your account. If you do not want your profile to be associated with Google, you must log out of Google before visiting our website.
Google has committed to complying with the Privacy Shield agreement between the EU and the USA on the collection, use and storage of personal data from EU member states, as published by the US Department of Commerce. You can find the certificate here.
You can prevent the transmission of your data to Google in connection with the use of Google Maps by disabling JavaScript in your browser settings or by not using the corresponding link on our website.
You can find extensive information from Google about data processing in connection with Google Maps here:
https://www.google.de/intl/de/policies/privacy/
e. YouTube
We have embedded videos on our website that are technically stored on a server of YouTube, LLC, 901 Cherry Ave, San Bruno, CA 94066, USA ("YouTube"), a subsidiary of Google. All personal data processed in connection with viewing these YouTube videos is processed by YouTube and not by us.
The YouTube videos are embedded in "extended privacy mode", i.e. no data about you is transmitted to YouTube for as long as you do not play the video. Only when you start the videos is personal data collected by or transmitted to YouTube. We have no influence on this data transmission.
When you watch a video, YouTube receives the information that you have accessed the subpage of our website on which the video is embedded. This is independent of whether you are logged in with any YouTube/Google credentials you may have. However, if you are logged in, your data will be directly linked to your account. You can find information about what other information is processed here: https://www.google.de/intl/de/policies/privacy/#infocollect.
If you do not want your YouTube/Google account profile to be linked to the playback of the video, you must log out before starting the video. YouTube stores your data as usage profiles and uses it for advertising, market research and/or the needs-based design of its website. Such evaluation is carried out in particular (even for users who are not logged in) to provide needs-based advertising and may also be used to inform other users of the social network about your activities on our website. You have the right to object to the creation of these user profiles on YouTube.
Further information about the purpose and scope of data processing by YouTube can be found at https://www.google.de/intl/de/policies/privacy.
2. Contact form
We offer the possibility of contacting our customer support via an electronic contact form. In the context of such enquiries, the following information must be provided, which serves the common interest in assigning enquiries, processing enquiries and solving underlying problems (legal basis: Art. 6(1)(b) GDPR or Art. 6(1)(f) GDPR) and is stored until the enquiry has been finally dealt with:
- Title
- First name, last name
- Email address
- Subject of the enquiry
Further details may be provided voluntarily.
We collect, store and use the data you provide in the context of contacting us exclusively for processing enquiries and solving underlying problems, and delete it after this purpose has been fulfilled, unless further storage and other processing is required for the performance of a contract with you or for the implementation of pre-contractual measures taken at your request (legal basis: Art. 6(1)(b) GDPR) or for compliance with a legal obligation to which we are subject (legal basis: Art. 6(1)(c) GDPR).
In the context of such enquiries, we also collect information for statistical purposes about the number of enquiries made in a given period and the frequency of enquiries on specific topics, in order to optimise our website and customer service, provided there are no overriding user interests in the protection of their personal data (legal basis: Art. 6(1)(f) GDPR). This data is stored and used exclusively in anonymised, aggregated form.
3. Disclosure of data to third parties
As a matter of principle, we do not transmit users' personal data to third parties without your prior express consent.
To provide some services, we work with service providers (e.g. payment service providers, hosting providers, etc.) who may process personal data on our instructions on the basis of a data processing agreement in connection with the provision of the respective service.
Your data is otherwise only disclosed in special exceptional cases, insofar as we are obliged or entitled to do so by law or by binding instruction of a public authority.
4. Where is the data stored?
We store and process the data collected in connection with the use of our websites exclusively on servers located within the European Union.
5. What protection measures apply to your personal data?
We make reasonable efforts to protect your personal data and to ensure the security of our systems in line with the current state of the art. To this end, we use, among other things, current encryption methods (SSL encryption). However, no method of transmission over the Internet or method of electronic data storage is 100% secure. We therefore cannot guarantee against unauthorised access to our servers and systems.
6. Storage duration
Unless otherwise stated in this privacy policy, we store personal data that comes to our knowledge in connection with the use of our website only until the respective purpose for which it was entrusted to us has been fulfilled or as long as we are legally obliged to do so. Once the purpose of use no longer applies, your personal data will be completely deleted.

Please therefore inform yourself about the type and scope of data use with the respective platform operator before visiting the linked pages.
8. Rights of the data subject
a) You have the right to request confirmation from us as to whether we are processing personal data concerning you. If this is the case, you have a right of access to this personal data to the extent provided by law (Art. 15 GDPR in conjunction with § 34 BDSG). This does not apply if

In the cases of Article 20(1) GDPR, there is also a right to data portability.
c) You have the right to lodge a complaint with the competent supervisory authority if you consider that the processing of personal data concerning you infringes the GDPR.
